About these terms
These terms are an agreement between COGO Data (Pty) Ltd (“COGO Data”, “we”, “us”) and the business that creates a Bayescope workspace or subscribes to Bayescope (“you”). By creating a workspace, subscribing or using Bayescope, you accept these terms on behalf of your business and confirm that you may do so.
Our Privacy policy, Delivery policy and Refund policy form part of these terms. You can save or print these pages at any time.
Bayescope is a business service. If you are a natural person contracting as a consumer, the Consumer Protection Act and the Electronic Communications and Transactions Act may give you further rights. Nothing in these terms limits those rights.
The service
Bayescope provides AI agents that research, keep business records current, prepare reports and messages, and send messages through Microsoft 365 mailboxes you connect, within limits you set. Each workspace includes up to three agents and a dedicated agent environment that COGO Data manages for you.
On Bayescope Omnichannel, your agents can also use LinkedIn and WhatsApp accounts that you connect through LinkupAPI, our channel provider. You connect each account on LinkupAPI's own page; we never see its password.
We describe the current features and allowances on this website and in the portal. Bayescope will change as we improve it. We will not materially reduce what you have paid for during a paid period.
Your workspace and account
- You need a business Microsoft 365 tenant, and an administrator who can approve the permissions Bayescope requests.
- You are responsible for the people you allow into your workspace and for what they do there.
- Keep sign-in details secure, and tell us promptly at info@cogodata.co.za if you suspect unauthorised access.
- The information you give us must be accurate and kept up to date.
Price, payment and renewal
- Bayescope Inbox costs R2,500 per workspace per month, excluding VAT: R2,875.00 including VAT at 15%.
- Bayescope Omnichannel costs R4,900 per workspace per month, excluding VAT: R5,635.00 including VAT at 15%. It includes up to 3 connected LinkedIn or WhatsApp accounts, 60 generated images and 8 short videos a month; unused allowances do not carry over.
- To change plan, cancel your current renewal and subscribe to the other plan once your paid period ends, or ask us to switch it sooner. We do not prorate automatically; if we switch your plan before a renewal, we agree any difference with you first.
- You pay monthly in advance, in South African rand. Paystack processes card payments; we never receive or store your full card details.
- Your subscription renews automatically each month until you cancel. There is no minimum term and no cancellation fee.
- If we change the price, we will tell you at least 30 days before the change applies to your next renewal.
- If a renewal payment fails, research and sending pause until payment succeeds. Your saved work stays available.
- Refunds are covered by our Refund policy.
Your data
You own the data in your workspace, including your business profile, instructions, research records, reports and messages, and the outputs created for you.
When your agents collect or use personal information for your purposes, such as the business contact details of people at other organisations, you are the responsible party under the Protection of Personal Information Act (POPIA) and COGO Data is your operator. As your operator, we:
- process that information only to provide Bayescope to you, on your instructions;
- keep it confidential and protect it with appropriate security safeguards;
- tell you without undue delay if we believe it has been accessed or acquired by an unauthorised person;
- return or delete it when you ask us to after your subscription ends, unless the law requires us to keep it.
We keep the opt-out and exclusion records needed to make sure that people who asked not to be contacted are not contacted again. Our Privacy policy explains how we handle account, billing and website information.
Your communications
You are responsible for the messages sent from your workspace and for having a lawful basis for each one. Section 69 of POPIA allows direct marketing by email or other electronic communication only to people who have consented or who are existing customers, and allows a business to ask for consent once.
Bayescope helps you follow these rules:
- An agent's first email to a new contact asks for permission rather than making a sales pitch.
- A checker reviews each draft before you approve it, and holds drafts that do not fit.
- Opt-outs apply across all your agents, and people who decline are not asked again.
Approval before sending is the default. If you turn on automatic sending for a task, you authorise messages that pass Bayescope's checks to be sent without individual review, and you remain responsible for them. You must not use Bayescope to send spam, to contact people who have opted out or to get around its controls.
Connected LinkedIn and WhatsApp accounts
- Connect only accounts that belong to you or your business and that you are allowed to use this way. You are responsible for following LinkedIn's and WhatsApp's terms and policies for those accounts.
- LinkedIn, WhatsApp and other platforms may limit, restrict or close an account they consider automated, even when activity stays within Bayescope's limits. We set conservative daily limits and working hours, but we cannot guarantee that a platform will not act against an account, and we are not liable if it does.
- The same rules apply on every channel. A first message to a new contact asks for permission, once, on one channel. WhatsApp is used only for people who have agreed to hear from you there or who wrote to you first.
- When your Omnichannel subscription ends, connected accounts are suspended and then disconnected from LinkupAPI. Your contact history and opt-outs stay in your workspace.
Acceptable use
You must not use Bayescope to:
- break the law or infringe anyone's rights, including privacy and intellectual property rights;
- collect special personal information or information about children;
- access another workspace, probe or overload our systems, or reverse engineer the service;
- instruct agents to bypass their limits, approvals or safeguards;
- build or train a competing product.
We may suspend activity that breaches these terms or puts the service or other people at risk. Unless the law prevents it, we will tell you why.
AI output
Agents use AI models and public sources. Even with evidence links, their results can be incomplete, out of date or wrong. Check important findings before relying on them, and review messages before you approve them. Bayescope does not give legal, financial or other professional advice.
Availability and support
We work to keep Bayescope available and to fix problems promptly. Bayescope depends on services we do not control, including Microsoft 365, hosting, AI model and search providers, LinkupAPI, LinkedIn, WhatsApp and Paystack, so we cannot guarantee uninterrupted availability. Planned maintenance may pause agents, and we will give notice where we can. For support, email info@cogodata.co.za.
Intellectual property
COGO Data owns Bayescope, its software and its content. While your subscription is active, you may use Bayescope for your business; this right is non-exclusive and cannot be transferred. Material that agents gather from third-party sources remains subject to its owners' rights.
Liability
To the extent the law allows:
- COGO Data is not liable for indirect or consequential loss, lost profits, or loss caused by services we do not control;
- our total liability for all claims in any 12-month period is limited to the subscription fees you paid in that period.
Nothing in these terms limits liability for gross negligence, fraud or wilful misconduct, or any liability that cannot lawfully be limited.
You indemnify COGO Data against third-party claims arising from content you provide, or from messages sent from your workspace in breach of these terms or the law.
Cancellation, suspension and termination
You may cancel at any time from Billing, as set out in our Refund policy. We may suspend or end your access for non-payment or a material breach of these terms, after notice where that is reasonable. When your access ends, your agents stop working and your data is handled as described under “Your data”.
Changes to these terms
We may update these terms. We will give you at least 30 days' notice of material changes, by email or in the portal. If you do not agree to a change, you may cancel before it takes effect.
Law and disputes
South African law governs these terms. Please contact us first so we can try to resolve any dispute. If we cannot, either party may refer it to a competent court in South Africa.
Notices
We send notices to your workspace owner's email address. Send legal notices to us at info@cogodata.co.za, with “Legal notice” in the subject line, or deliver them to our registered office. Our full supplier details are listed on this page.
